If my partner gives up his work can I still get child maintenance?
The Child Maintenance Service works out how much maintenance should be paid based on the earnings or benefits of the person paying maintenance. If your ex is not working there is no maintenance to be paid unless s/he is getting a benefit such as Jobseeker’s Allowance or Universal credit when a flat rate of £7 per week is payable. Your ex can, however, choose to pay some maintenance if they do not have earnings.
